The case arose after our client was arrested in November 2024, following allegations made by her husband during the breakdown of their relationship. At the time, the couple had been in discussions regarding marriage, but the relationship deteriorated, ultimately leading to the complaint.

These arguments were accepted, resulting in both charges being dropped before trial and significantly narrowing the scope of the case.

During the trial, an important legal application was made by counsel Tobias Smith of 25 Bedford Row to adduce evidence of the complainant’s previous convictions.
This application was based on the complainant’s repeated focus on the defendant’s character, making credibility a central issue for the jury to consider. The court granted the application, allowing the jury to hear relevant background information that could impact the reliability of the complainant’s evidence. This proved to be a crucial element of the defence strategy.
Cross-Examination and evidence at trial
The defence team conducted detailed and methodical cross-examination of the complainant, the attending police officers, and the defendant.
Through careful questioning, inconsistencies in the prosecution’s case were exposed and the defence position was reinforced. The evidence demonstrated that the allegations were unfounded and arose in the context of a deteriorating personal relationship.
Unanimous not guilty verdicts
After hearing all of the evidence, the jury was sent out to deliberate and returned unanimous not guilty verdicts on causing fear of violence as well as the alternative offence of harassment.
This outcome represents a complete acquittal, with the client cleared of all allegations.
