In criminal law, the system often frames outcomes in binary terms — guilty or not guilty, custodial sentence or not. But the reality is far more complex. Behind every case is a human story, and behind every client is a set of personal circumstances that deserve to be understood.
As criminal defence solicitors, we are expected to navigate legal arguments and procedure. But in truth, we also become social workers, confidantes, mentors — roles that are not in the job description, but often define what we do best. A recent case handled by Shardonae Momrelle-Bartley highlights exactly this.
Our client, a vulnerable young man, suffers from severe ADHD and suspected autism. Previously, he was arrested on a drugs possession charge which he received a conditional discharge for.
What happens when bail conditions cause problems?
Unfortunately, he was later arrested again, this time for possession of an offensive weapon which therefore put him in breach of the conditional discharge. This means that our client could be sentenced for both cases and receive a harsher punishment. As part of his bail conditions for the current case, he was tagged.
Due to his physical & mental conditions, the electronic tag — which was fitted directly onto his skin — caused intense discomfort and distress. One evening, in extreme frustration undoubtedly brought on by his condition, he threatened removing the tag and leaving the house. His mother, understandably distressed, called Shardonae late that evening.
Shardonae reassured her that we would take action — and she kept her promise.
Within the same week, she brought the matter before the court for a bail variation hearing. She asked our client’s mother for supporting documentation of his vulnerabilities. Shardonae instructed Ms Samantha Gilmour who presented clear evidence of the genuine difficulties our client faced in complying with the bail condition. The Court listened, understood the basis of Samantha’s application, and ordered the removal of the tag.
A touching review
Both the client and his mother were relieved and grateful. His mother later shared a heartfelt message of thanks to Shardonae and Samantha:

I think client care is a core part of what we do. It is not just about the law – it is also about supporting clients/family through the whole process and making sure that they are as relaxed as possible. I also believe that clients being honest about their situation can help us make an informed decision about what next steps to take. In this case, the client was so agitated by the tag which stems from his condition. I believe that urgent action was needed otherwise he would have taken matters into his own hands.
