Successful reduction of over £700k in POCA proceedings

Mr. KS entrusted his Proceeds of Crime case to MK Law after losing confidence in his previous legal representation. He was initially convicted for being involved in conspiring to supply cocaine and possessing criminal proceeds, as part of Operation Eternal. Operation Eternal gained press coverage, when it was described as ‘the most significant operation the Met has ever launched against serious and organised crime’. The operation targeted organised criminal networks who were using Encrochat, a military-grade encrypted communication system, for drug and firearm trafficking. Following the hacking of Encrochat by the police and their partners, over 700 arrests were made across Europe. It also saw the seizure of over £13 million in cash in London alone.

After Mr KS’s conviction the Prosecution originally sought to recoup a benefit figure of £1,139,595.09 with an available amount of £1,104,056.58. Our client disputed this amount but felt he wasn’t getting the service from his previous legal team. He decided to change lawyer and Nadia Ryman took the case on. Nadia instructed Barrister Rebecca Thomas from 5SAH chambers to assist with the forensically analysis of the EncroChat messages. They were able to highlight a number of areas of double accounting. This lead to successfully reducing the benefit figure to £1,081,860.53 but more significantly reducing the available amount to just £369,090.44. That’s a reduction £712,000.
