A client of Emma Lewis has been unanimously acquitted of two counts of assault by penetration following a trial at Inner London Crown Court (ILCC).
The client, now aged 21, faced allegations dating back to 2020–2021, when he was 16 years old. He was represented at trial by Manisha Knights, who conducted detailed and robust cross-examination on his behalf.
Serious sexual allegations successfully defended
After hearing the evidence and submissions, the jury returned unanimous not guilty verdicts in under three hours.
Prior to trial, representations were made to the Crown Prosecution Service (CPS) highlighting significant weaknesses in the prosecution case. Despite these concerns, the CPS proceeded. Those weaknesses were ultimately exposed during the course of the trial.
This case also highlights an important procedural point. Had the allegations been charged closer to the time they were said to have occurred, the matter would likely have been heard in the Youth Court rather than before a jury in the Crown Court. In cases where credibility is central, the forum in which a case is heard can be highly significant.
This outcome reinforces the vital role of juries in ensuring fair trials, particularly in cases involving serious allegations where issues of credibility and plausibility are key.
