The defendant appeared charged with a matter of ‘Disobeying any Lawful Order’ contrary to PR 51 (22) / YOI R 55 (25) in relation to diluting a sample for a random MDT and appeared for an adjudication in front of the District Judge on 11th April 2017.
After a full contested hearing the Defendant was duly found guilty of the matter against him. The starting point for such an offence is 32 days and this should have been increased upon after Trial, however after detailed mitigation was put forward by Jonathan Mellody the defendant was awarded an incredibly lenient sentence of an additional 12 days.
